Philips v. Gelpke, 382 N.J. Super. 505 (App. Div. 2006)
Successfully represented defendant in case where court held that claim of childhood sexual abuse based on recalled memories requires expert testimony on dissociative amnesia. Reversed by the New Jersey Supreme Court and remanded for consideration of further appeal issues.

Jane Doe v. XYC Corp., 382 N.J. Super. 122 (App. Div. 2005)
Court ruled that employer had duty to investigate employee′s use of internet when reason to believe employee is viewing child pornography and to report such activity to police.

Joye v, Hunterdon Central Regional School Board, 176 N.J. 568 (2003)
Successfully represented School District random drug testing program challenged on constitutional grounds.

Accardi v. Enviro-Pak Systems Co., 317 N.J. Super. 457 (App. Div. 1999)
Established potential liability of landowner who retained control over work being performed on property. Subsequent jury verdict for plaintiffs for 2.2 million dollars.

Nowacki v. Community Medical Center, 279 N.J. Super. 276 (App. Div. 1993)
Court agreed that use of medical records at trial containing complex diagnosis was hearsay and affirmed medical malpractice award for plaintiff.

DeLane v. City of Newark, 343 N.J. Super. 225 (App. Div. 2001)
Successfully represented firefighter′s widow in excepting survival action recovery from workers′ compensation lien.

Radwan v. Carteret Board of Education, 62 Fed. Appx. 34 (3d Cir. 2003)
Reversed Trial Court Order for a new trial in employment litigation where jury had awarded no compensatory damages or punitive damages under state law but had awarded punitive damages under federal law.

English v. Board of Education, 301 F.3d 69 (3d Cir. 2003)
Represented local school board in constitutional challenge to New Jersey send receive statute.

Banquesource Capital Corp v. Pine Brook Care Center, 265 N.J. Super. 446 (1993)
Successfully defended nursing home in suit by broker for commission on failed mortgage application.

Tustin v. Heckler, 591 F. Supp. 1049 (D.N.J.), rev′d, 749 F.2d 1055 (3d Cir. 1984)
Represented class of social security recipients in Equal Protection challenge to their removal from disability rolls.

Raniero v. Antun, 943 F. Supp. 413 (D.N.J. 1996)
Won summary judgment for local school board in claim that failure to promote violated plaintiff′s First Amendment rights.

Dissinger v. Schomburg Charter School

Succeeded on behalf of employee on summary judgment, motion on liability for breach of employment contract and obtained an award at trial on damages for $247,834.00.

Lukach v. Caruso Automotive, (Workers' Compensation Court, Lebanon, 2009)
Successful trial of worker's compensation claim for medical benefits and permanent disability award on behalf of employee. Employer initially denied the claim.

John Doe v. ABC Corp. (New Jersey Superior Court, Middlesex County, 2008)
1.6 million dollar confidential settlement of age discrimination case.

L.M. v. Church & Dwright, (Workers' Compensation Court, Mercer County-Appellate Division 2008)
A Workers' Compensation claim where the employer denied that Petitioner's shoulder surgeries were related to her secretarial duties. The Workers' Compensation Court, after 6 days of trial, awarded Petitioner total disability. On January 30, 2008, the New Jersey Appellate Division affirmed the Workers' Compensation Court Decision.

Cittadino v. Younger, (Monmouth County, 2005)
2.1 million dollar settlement for Plaintiff in automobile accident. Reported as one of the top 50 in cases in New Jersey for 2005.

Davis v. City of Trenton (OAL, 2002)
Represented police officer in multi-day hearing before Administrative Law Judge. Succeeded in getting police officer reinstated and awarded back pay.

Dillon v. A&P, (Passaic County, 2000)
$900.000.00 verdict in sex harassment/retaliation case.

Gordon v. Witco (Morris County, 1996)
$10,500,00 verdict for plaintiffs in age discrimination case.

Robert Wilson's Criminal Cases:

Both juvenile and adult clients accused of indictable crimes (juvenile matters typically are filed in the Family Court, but can have repercussions similar to those of regular criminal matters).

Juvenile

  • Obtained non-custodial probation for a juvenile who had committed an assaultive robbery on videotape in Somerset County, New Jersey (2008).
  • Represented a Readington, New Jersey juvenile charged with second degree resisting and eluding arrest, third degree unlawful taking of a vehicle, and obstructing the administration of the law; a conviction would have resulted in mandatory incarceration. The juvenile court dismissed all charges and the client was accepted into an extremely selective college (2004).

Adult

  • In April 2010, obtained a dismissal of a shoplifting charge against a client from Warren, New Jersey. This professional client will continue to have a clean criminal record, which is crucial, because the client's employer conducts random checks of its employees' records.
  • In March 2010, obtained a dismissal of a shoplifting charge in Woodbridge, New Jersey. The client, an insurance professional, was exonerated and will continue to have a clean criminal record.
  • Obtained the dismissal of an assault charge filed against a Bridgewater woman in the Fall of 2009.
  • Obtained dismissal of drug paraphernalia and underage consumption of alcohol charges against a Bridgewater college student in the Fall of 2009. The young man pleaded guilty to a town ordinance and paid a small fine.
  • In the Fall of 2009, I got a Bernardsville burglary defendant into the Pre-trial Intervention program so that the criminal charge may be dismissed.
  • Obtained Pre-Trial Intervention for an unlawful immigrant client indicted for unlawful trespass (2009).
  • Obtained a dismissal for an unlawful immigrant client indicted for unlawful use of heroin (2009).
  • Obtained a dismissal of a Hillsborough client's charges of third degree possession of a controlled dangerous substance and fourth degree unlawful taking of a means of conveyance (commonly referred to as "joyriding") (2009).
  • Took over a Somerset County matter where the client had previously pleaded guilty to three counts of third degree distribution of a controlled dangerous substance. I demonstrated that the client was guilty of only one count; the other two counts were lesser offenses. Instead of the 180 days in jail set forth in the previous plea agreement, the client spent no overnights in jail, but rather served community service working for the Sheriff's Department for a number of weekends (2008).
  • Obtained pretrial intervention or PTI (a dismissal if the client stays out of trouble) for a young Somerville client who had committed multiple acts of vandalism, over the initial objection of both the prosecutor and the court (2008).
  • Obtained PTI for a Bedminster client charged with hindering apprehension for sneaking two burglars away from a crime scene during a police manhunt (2008).
  • Successfully appealed a Middlesex Borough, New Jersey client's Municipal Court convictions of criminal mischief and harassment. Mr. Wilson had not represented the client on the initial trial. On appeal, the client's criminal record was wiped clean and all monies the client had paid in fines were returned to him (2008).
  • Obtained a dismissal of a charge of unlawful possession of a firearm for a client who was a college senior from a prestigious university with a bright future (2007).
  • Won a rare motion to suppress drugs seized from a car stopped in a parking lot in Franklin Township, New Jersey. All charges were dropped following the successful suppression of the evidence (2005).

Municipal Court/DWI/Insurance

DWI

  • In March 2010, obtained a dismissal of years old charges of DWI and refusal against a Minnesota resident who had previously lived in New Jersey. This will allow him to regain his driver's license after it had been suspended for years.
  • In the Fall of 2009, successfully excluded breath alcohol readings of .14 for a Somerset County DWI defendant. The defendant lost his driver's license for 3 months, instead of 7 to 12 months.
  • In the winter of 2009, a Somerset County client faced a 7 to 12 month loss of driver's license for DWI with a BAC reading of above .10. Due to various defenses raised by the firm, she lost her license for 3 months only.
  • Obtained a dismissal of an Annandale client's DWI charge based on heroin abuse (2009).
  • In 2009, made a successful "Laurick" application to prevent a client faced with a third DWI offense from serving a mandatory six month jail sentence (2009).
  • In November 2008, obtained a dismissal of a Bridgewater, New Jersey woman's charge of DWI. The client had an Alcotest blood alcohol reading of .12.
  • In the Fall of 2008, succeeded in having a Bridgewater, New Jersey client's third DWI offense treated as a second offense. Instead of a mandatory six months in jail and 10-year loss of his driver's license, the client spent no time in jail and lost his license for only two years.
  • In the Summer of 2008, obtained a dismissal of a young woman's charge of DWI in Plainsboro, New Jersey.
